1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Associo iOS application ("App") provided by Associo ("Associo," "we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of the App

Associo is a language learning application that allows users to create, organize, import, export, and study flashcards, decks, folders, and related educational content.

Features, functionality, pricing, availability, and feature limitations may change over time as the App is updated, improved, or transitioned between free and paid offerings.

Certain features may currently be provided free of charge for promotional, testing, introductory, or evaluation purposes. We reserve the right to add, remove, modify, limit, discontinue, or require payment for any feature at any time, subject to applicable law and Apple App Store policies.

3. Eligibility

You must be at least 13 years old to use the App. By using Associo, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

4. Accounts and Data Storage

Associo does not currently require user accounts.

All user-created content and App data are stored locally on your device. Associo does not provide cloud storage, automatic cloud backup, or account-based synchronization services.

Deleting the App, reinstalling the App, resetting your device, replacing your device, or certain operating system actions may permanently delete your data.

Associo may provide tools that allow you to manually export and import backup files. You are solely responsible for creating, maintaining, and verifying your own backups.

5. Subscriptions and Payments

Associo may offer free and paid features, including subscription-based services such as "Associo Pro."

Some features may currently be available at no cost during introductory, promotional, beta, or evaluation periods. We reserve the right to introduce, modify, discontinue, or charge for features in future versions of the App.

All purchases, subscriptions, billing, and refunds are processed through Apple's App Store and are subject to Apple's terms and policies.

Subscription pricing, available features, and subscription offerings may change at any time. Changes will apply prospectively and will not affect any active subscription period already purchased unless otherwise permitted by Apple or required by law.

You are responsible for managing your subscriptions through your Apple ID account settings.

6. User Content

You retain ownership of any flashcards, decks, notes, text, or other content you create within Associo ("User Content").

You are solely responsible for your User Content and for ensuring that it does not violate any applicable laws or third-party rights.

You agree not to create, import, share, or distribute content that:

  • Violates intellectual property rights

  • Contains unlawful, abusive, defamatory, or harmful material

  • Contains malicious software or harmful code

  • Violates applicable laws or regulations

Associo does not monitor or review user-created content.

7. Exporting and Sharing Content

Associo may allow users to export or share decks and related content. You are solely responsible for any files you export, share, transmit, or distribute outside the App.

We are not responsible for how exported content is used by you or others.

8. Intellectual Property

The App, including its design, branding, software, user interface, graphics, and functionality, is owned by Associo and protected by applicable intellectual property laws.

You may not copy, modify, distribute, reverse engineer, decompile, disassemble, or create derivative works of the App except as permitted by applicable law.

"Associo" and related branding may not be used without prior written permission.

9. Acceptable Use

You agree not to:

  • Use the App for unlawful purposes

  • Attempt to interfere with or disrupt the App

  • Attempt to gain unauthorized access to systems or software

  • Use automated methods to abuse or exploit the App

  • Misrepresent your relationship with Associo

10. Educational Purpose Disclaimer

Associo is provided for educational and informational purposes only. We do not guarantee language proficiency, fluency, academic performance, certification results, or learning outcomes from using the App.

11. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, ASSOCIO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND COMPATIBILITY.

WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPATIBLE WITH ALL DEVICES OR OPERATING SYSTEM VERSIONS, OR FREE FROM BUGS, DEFECTS, DATA CORRUPTION, OR DATA LOSS.

12. Data Storage, Backup, and Data Loss

All User Content is stored locally on your device.

You acknowledge and agree that you are solely responsible for maintaining backups of your data. Associo strongly recommends regularly exporting backup files and storing those backups in a safe location outside the App.

Deleting the App, deleting App data, reinstalling the App, replacing or resetting your device, operating system updates, device failures, user error, or other technical issues may result in permanent loss of User Content.

Although Associo may provide import, export, backup, restore, synchronization, or sharing functionality, we do not guarantee that these features will operate correctly in all circumstances or that they will prevent data loss.

To the fullest extent permitted by law, Associo shall not be responsible or liable for any loss, corruption, deletion, alteration, inaccuracy, duplication, failed restoration, failed import, failed export, inability to recover, or other loss of User Content, regardless of cause, including but not limited to:

  • Software bugs or defects

  • Application crashes

  • Import or export failures

  • Corrupted backup files

  • User error

  • Device malfunction or replacement

  • Operating system updates

  • Third-party file storage or sharing services

  • Unexpected technical issues

You acknowledge that use of the App involves inherent risks associated with storing electronic data and agree that you use the App and any backup functionality entirely at your own risk.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ASSOCIO AND ITS OWNERS, OPERATORS, AFFILIATES, LICENSORS, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, INABILITY TO USE, OR RELIANCE ON THE APP.

THIS LIMITATION INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS, CORRUPTION, OR INABILITY TO RECOVER USER CONTENT, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF GOODWILL, DEVICE MALFUNCTION, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, IF YOU ARE DISSATISFIED WITH THE APP, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE APP AND UNINSTALL IT.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Termination

We reserve the right to suspend or terminate access to the App or certain features at any time if we believe you have violated these Terms or applicable laws.

You may stop using the App at any time by uninstalling it from your device.

15. Third-Party Services

Associo may rely on third-party technologies and services provided by Apple, including the App Store, StoreKit, Text-to-Speech services, file sharing functionality, and other operating system features.

Your use of those services may also be subject to Apple's terms, licenses, and privacy policies.

We are not responsible for the availability, reliability, accuracy, security, performance, or failure of any third-party services or operating system features.

16. Changes to These Terms

We may update these Terms from time to time. If material changes are made, we may notify users through the App, App Store updates, or by updating the "Last Updated" date above.

Continued use of the App after changes become effective constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles.
